The results of toxicological analysis of blood and urine samples from female victims of alleged non-consensual sexual activity are reported. Ethanol was the dominant psychoactive substance identified in blood at mean and median concentrations of 1.24 g/L and 1.19 g/L, respectively. Blood samples also contained a wide spectrum of therapeutic drugs, such as benzodiazepines (e.g. diazepam, alprazolam) and antidepressants (citalopram, fluoxetine), although at concentrations generally considered within the therapeutic range. Poly-drug use was a common finding. Among illicit drugs, amphetamine and cannabis were most often the substances identified. Whether prescription drugs were being used in accordance with a physician's ordination or covertly administered was not investigated. Examples are given of expert opinions provided to the courts to aid in the interpreting of the toxicological results. However, relating the blood-concentrations of ethanol and/or drugs to the degree of incapacitation or helplessness of the victim is fraught with difficulties.
